Rolf Schwartmann examines the agreements under international law made within the WTO and shows that many of these create a uniformly applicable and binding legal standard. A lot of provisions grant private persons and companies a legal status. He also demonstrates that these norms are in parts directly applicable and thereby create substantive and procedural law that is binding in the member states. In relation to this issue, the author gives a critical analysis of the existing rules laid down in the WTO agreements as they pertain to the rulings of the WTO courts, the European Court of Justice and literature on this matter. Before doing so, Schwartmann studies the direct applicability of international agreements in international economic law outside of WTO law and categorizes the direct applicability of agreements under international economic law from a legal perspective on the whole.
